How to File a Copyright Complaint
To submit a valid DMCA takedown request, your written notice must include all of the following:
A description of the copyrighted work you believe has been infringed.
A clear description of the location of the allegedly infringing material on our site (a specific URL is best).
Your contact information, including your full name, mailing address, telephone number, and email address.
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
A statement that the information in your notice is accurate, and a statement, made under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.
Your physical or electronic signature.
Incomplete notices may delay or prevent action. We recommend consulting with legal counsel before submitting any claim.
Counter-Notice Instructions
If your content has been removed due to a DMCA complaint and you believe it was taken down in error or as a result of misidentification, you may submit a counter-notification to our designated agent at the contact information above. Your counter-notice must include:
Your physical or electronic signature.
Identification of the material that was removed and the location at which it appeared before it was removed.
A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
Your name, address, and telephone number.
A statement that you consent to the jurisdiction of the federal court in the judicial district where your address is located (or, if your address is outside the United States, the federal court for any judicial district in which BrokerBoost.com LLC may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of that person.
Upon receipt of a valid counter-notification, we will forward a copy to the original complainant. The removed material may be restored between 10 and 14 business days after the counter-notification is received, unless the complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.
Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), BrokerBoost.com LLC has adopted a policy of terminating, in appropriate circumstances, the accounts and access of users, account holders, and clients who are repeat infringers of copyright. This policy applies to all services provided by BrokerBoost.com LLC, including managed websites operated on behalf of clients.
